Terms of Service

Effective October 18, 2026

These terms govern your use of PhotoKind at photokind.ai, including AI generation, editing, media storage, imports and purchases. By using the service or purchasing credits, you agree to these terms and our Acceptable Use Policy.

Eligibility and account security

You must be at least 18 and able to enter a binding agreement. Provide accurate information and keep your access token secure. It grants access to your account and media. You are responsible for activity you authorize. Contact us promptly about suspected unauthorized access.

Credits and purchases

Prices are in USD. Credits are prepaid access to supported services, not money, a deposit, an investment, or a transferable asset. Purchases are one-time payments with no automatic renewal. Credits do not expire while your account remains open. Generation costs vary and are shown before submission. Future prices may change; completed purchases and approved jobs retain the price accepted at checkout or submission. The Refund Policy and Delivery Policy form part of these terms.

Your content and AI output

You retain rights you already hold in your uploads. You grant PhotoKind and its service providers permission to process, store, transmit and display your content as needed to provide the features you request, maintain security and meet legal obligations. You must have rights and consent for uploaded material and depicted people. You may use outputs commercially to the extent you hold the necessary rights and the selected model's applicable terms allow. We do not guarantee originality, exclusivity, copyright protection or clearance of third-party rights. AI can produce inaccurate, unexpected or unsuitable results; review outputs before use or publication.

Service operation

Processing times, model availability and results vary. Imported content depends on access granted by the source service. Keep independent copies of important files. We may change features and suspend abusive or unlawful activity. You may stop using the service at any time and request account closure through support; disconnecting a token alone does not delete stored content.

Disclaimers and responsibility

To the extent permitted by law, the service is provided as available without guarantees of uninterrupted operation or fitness for a particular purpose. We are not liable for indirect or consequential losses. Our aggregate liability arising from the service is limited to the amount you paid PhotoKind in the twelve months before the event giving rise to the claim. These limits do not exclude liability that cannot lawfully be excluded, including applicable consumer protections.

Changes and questions

Material changes will be posted with an updated effective date, and additional notice will be provided where required. Changes do not retroactively alter completed purchases. Contact us to resolve a concern before escalating it. Nothing in these terms removes non-waivable rights or prevents you from seeking remedies available under applicable law.
